You cannot marry a married woman nor keep her with you along with her child unless she gets a divorce from her husband. Her husband may be cruel. But in order to give protection, you may not venture in such a way because it amounts to illegally enticing away one's wife and abduction of his daughter. Her husband may lodge a police complaint against you or file criminal cases against you. Therefore, you are advised to assist her in giving a police complaint for domestic violence against her husband first and then under police guidance give her protection.

first get the divorce decree then only you can marry that too after laps of period prescribed for appeal of no notice of appeal received. ... Read More

If the accused are not present at a given date in 138 NIA case, then can the petitioner or petitioner's advocate give an application to the magistrate to issue warrant against them? and will the magistrate issue warrant on the basis of such an application

There is no need to give an application, an oral request will suffice. The magistrate can issue the warrant unless he decides to take a lenient view having regard to the facts and circumstances of the case.

if you are muslim then no divorce decree from court is required otherwise you are required to get the stamp of court on your settlement meaning thereby you have to obtain the decree of divorce from court for dissolution of your marriage. ... Read More
